Terms of Service

Atlaset Alpha Terms of Service

Effective date: 17-July, 2026

Important Alpha warning: Atlaset is an experimental Alpha product. It may be incomplete, inaccurate, unavailable, insecure, changed, reset or discontinued, and data may be lost. Do not use Atlaset as your only record or storage location, and do not rely on it for legal, financial, tax, investment, insurance, succession, compliance or other important decisions. Keep independent copies and obtain professional advice where appropriate.

1. About these Terms

These Terms govern your use of the Atlaset application at app.atlaset.ai, the website at atlaset.ai and related Alpha services (together, Atlaset or the Service).

The Service is provided by:

Whimsy OÜ
Registry code: 17495721
Jalgpalli tn 21, 11312 Tallinn, Estonia
Email: atlaset@proton.me

By creating an account, accepting an invitation or using Atlaset, you agree to these Terms. You must be at least 18. If you use Atlaset for an organisation, you confirm that you may bind it.

Alpha access is personal, limited, revocable and normally invitation-only. It does not guarantee continued access, a future release, any particular feature or preferential pricing.

2. What Atlaset is — and is not

Atlaset is an experimental tool for organising and visualising information about people, entities, assets, liabilities, documents and relationships.

Atlaset does not verify whether information is accurate, complete, current or legally effective. A node, relationship, label, percentage, value or other output does not prove ownership, control, authority, liability or any other legal status.

Atlaset is not an official register, accounting system, legal instrument, records-retention system or backup service. It does not provide legal, financial, tax, investment, insurance, accounting, estate-planning, compliance or other professional advice, and no fiduciary or advisory relationship is created.

You are responsible for checking important information and obtaining qualified advice before making decisions.

3. Accounts, User Content and privacy

Keep your account information accurate and your credentials secure. You are responsible for activity through your account unless it results from our failure to comply with mandatory law. Tell us promptly if you suspect unauthorised access.

User Content means information, documents, notes, files and other material that you enter or upload for storage, organisation or display in Atlaset. You keep any intellectual-property rights you have in User Content.

You give us and our service providers a limited, non-exclusive licence to host, process, copy, transmit, secure and display User Content only as reasonably needed to provide Atlaset, support you, protect the Service and comply with law. This licence ends when the content is deleted from active systems, subject to backups, legal requirements and the Atlaset Privacy Notice.

You confirm that you may lawfully provide User Content and that it does not infringe another person’s rights. You are responsible for information about other people and must only enter personal data that is relevant and reasonably necessary.

Do not store passwords, authentication codes, full payment-card details, banking credentials, private keys, cryptocurrency seed phrases, access tokens, government identity documents, data about children, unlawfully obtained information or unnecessary health, biometric, genetic, criminal-record or similarly sensitive information.

Our handling of personal data is described in the Atlaset Privacy Notice.

4. Acceptable use

You must not:

  • use Atlaset unlawfully, fraudulently, to infringe rights, or to monitor, profile, harass or threaten another person;
  • upload malware, interfere with the Service, bypass restrictions, gain unauthorised access or test vulnerabilities without written permission;
  • scrape Atlaset, reverse engineer it except where law expressly permits, copy it to build a materially competing product, or resell or sublicense Alpha access;
  • use Atlaset to make automated decisions that have legal or similarly significant effects on another person;
  • help anyone do any of the above.

Report security issues privately to atlaset@proton.me and do not exploit them beyond what is reasonably necessary to identify and report them.

5. Your licence and Atlaset intellectual property

We give you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to use Atlaset during the Alpha for your own internal purposes.

Atlaset’s software, interface, designs, structures, documentation, branding and other materials are owned by us and/or our licensors. No other rights are transferred to you. You may not reproduce, distribute, make Atlaset available to others, create derivative products from it or exploit it commercially without written permission.

6. Feedback

Feedback means suggestions, ideas, feature requests, concepts, improvements, test results, bug reports, comments or other input that you voluntarily provide about Atlaset. It does not include User Content submitted mainly for storage or personal data unrelated to product feedback.

Feedback is not confidential. Do not include confidential information, material you cannot lawfully provide, credentials, security secrets or unnecessary personal data.

To the fullest extent permitted by law, you assign to Whimsy OÜ all transferable intellectual-property rights in Feedback. If a right cannot be assigned, you grant Whimsy OÜ a worldwide, perpetual, irrevocable, transferable, sublicensable and royalty-free licence to use, copy, modify, combine, publish, distribute and commercialise the Feedback for any purpose.

Where the law permits, you consent to modification and use without attribution and agree not to assert moral or similar rights.

Whimsy OÜ may share and transfer Feedback and the related rights to Atlaset’s founders, authorised contributors and any current or future owner or operator of Atlaset. They may use it without payment, accounting or attribution.

This Section does not transfer ownership of User Content or treat personal data as property. Personal data contained in Feedback will be handled under the Atlaset Privacy Notice and should be minimised where reasonably possible.

7. Alpha changes, third parties and ending access

Atlaset has no service-level agreement, uptime commitment or guaranteed support time. It may rely on third-party services that we do not control.

We may change or remove features, alter data structures, introduce limits, perform maintenance, reset accounts or data, suspend access or discontinue the Alpha. We will try to give reasonable notice of material planned changes where practicable, but may act without notice for security, legal, technical or operational reasons.

You may stop using Atlaset at any time. We may suspend or end access if you breach these Terms, create a security or legal risk, or for a legitimate Alpha product or operational reason.

Where reasonably practicable, we will provide notice and an opportunity to export available data. After access ends, User Content may be deleted, although restricted copies may remain temporarily in backups or where law requires. Keep independent copies of anything important.

8. Disclaimers, liability and business users

To the maximum extent permitted by law, Atlaset is provided “as is”, “as available” and “with all faults”. We do not promise that it will meet your needs, remain available, preserve data, produce accurate results, correctly represent ownership or relationships, or be free from defects or third-party interference.

Nothing in these Terms excludes rights or liability that cannot lawfully be excluded, including mandatory consumer and data-protection rights and liability for fraud or death or personal injury caused by negligence.

Subject to those mandatory exceptions, Whimsy OÜ and its founders, directors, personnel, contractors and licensors are not liable for indirect or consequential loss; lost income, profit, business, opportunity, goodwill or savings; business interruption; loss, corruption, disclosure or recreation of data; decisions based on Atlaset; inaccurate or incomplete outputs; third-party services; or changes, suspension or discontinuation of the Alpha.

Subject to the same exceptions, Whimsy OÜ’s total aggregate liability relating to Atlaset or these Terms will not exceed the greater of EUR 100 or the amount you paid Whimsy OÜ for Atlaset during the 12 months before the event giving rise to the claim. For consumers, these limits apply only to the extent permitted by mandatory law.

If you use Atlaset for a business or professional purpose, you will indemnify Whimsy OÜ and its licensors against reasonable third-party claims and costs caused by your unlawful User Content, infringement of third-party rights or material breach of these Terms, except to the extent caused by our own breach or unlawful conduct. This does not apply to consumers where prohibited or unfair.

9. Updates, transfer, law and contact

We may update these Terms for changes to the Alpha, security, law, third-party services or legitimate operations. We will notify you of material changes by email, through Atlaset or by another reasonable method. Continued use after the effective date means acceptance where permitted by law.

We may transfer these Terms, the Service and rights in Feedback to Atlaset’s founders, a future Atlaset owner or operator, or another entity as part of a restructuring, merger, acquisition or sale. The receiving party must assume the relevant service obligations, and we will notify you of a material change to the provider. You may not transfer your rights or obligations without our written consent.

These Terms are governed by Estonian law. This does not remove mandatory protections available to consumers under the law of their country of residence. Business users agree to the exclusive jurisdiction of the competent Estonian courts, with Harju County Court as the court of first instance where applicable. Consumers may use any court available under mandatory law.

These Terms and any expressly applicable Alpha invitation conditions form the agreement governing your use of Atlaset. If one provision is invalid, the rest remains effective. A failure to enforce a provision is not a waiver.

Questions, complaints and legal notices may be sent to Whimsy OÜ, registry code 17495721, Jalgpalli tn 21, 11312 Tallinn, Estonia; email: atlaset@proton.me.
